제1장 총칙

제1조 (목적)

본 약관은 주식회사 보아스헬스(이하 "회사")가 제공하는 스마트보아스(SmartBoaz) 애플리케이션(이하 "앱") 및 관련 서비스(이하 "서비스")의 이용과 관련하여 회사와 이용자의 권리, 의무 및 책임사항을 규정함을 목적으로 합니다.

제2조 (정의)

1. "이용자"란 본 약관에 따라 회사가 제공하는 서비스를 이용하는 자를 의미합니다.

2. "앱"이란 이용자가 스마트폰 등을 통해 다운로드하여 사용할 수 있는 스마트보아스 소프트웨어를 의미합니다.

3. "제품"이란 회사가 제공하는 AI 기반 코골이 완화 및 수면 케어 기기(스마트보아스)를 의미합니다.

제3조 (약관의 효력 및 변경)

1. 본 약관은 앱 및 회사 웹사이트에서 공지함으로써 효력이 발생합니다.

2. 회사는 법령을 준수하는 범위에서 약관을 개정할 수 있으며, 변경된 약관은 사전 공지 후 효력이 발생합니다.

제2장 서비스 이용

제4조 (서비스의 제공)

1. 회사는 이용자에게 스마트보아스 제품과 연동된 앱을 통해 코골이 소리 인식, 분석 및 맞춤형 수면 관리 솔루션을 제공합니다.

2. 회사는 최상의 서비스를 제공하기 위해 업데이트 및 유지보수를 진행할 수 있습니다.

3. 본 서비스는 의료 기기가 아닌 웰니스 제품으로, 건강 진단이나 치료를 목적으로 제공되지 않습니다.

제5조 (서비스 이용 제한 및 해지)

1. 이용자가 아래 행위를 하는 경우 서비스 이용이 제한될 수 있습니다. 

o 불법적인 목적의 사용

o 타인의 권리를 침해하는 행위

o 서비스의 정상적인 운영을 방해하는 행위

o 허위 정보 입력, 계정 공유 및 무단 접근 시도

2. 회사는 이용약관 위반 시 사전 통지 없이 서비스 이용을 중지할 수 있습니다.

제3장 개인정보 처리방침

제6조 (개인정보 수집 항목 및 목적)

1. 회사는 다음과 같은 개인정보를 수집할 수 있습니다. 

o 필수 수집 항목: 이름, 이메일, 기기 정보, 코골이 소리 데이터

o 선택 수집 항목: 수면 패턴, 건강 상태 정보

2. 수집된 개인정보는 다음과 같은 목적에 활용됩니다. 

o 서비스 제공 및 고객 지원

o 코골이 소리 분석 및 맞춤형 수면 관리

o 서비스 개선 및 연구 개발

제7조 (개인정보 보관 및 파기)

1. 회사는 개인정보를 법령에서 정한 기간 동안 보관하며, 목적이 달성된 후에는 즉시 파기합니다.

2. 이용자는 언제든지 자신의 개인정보 열람, 수정, 삭제를 요청할 수 있습니다.

제8조 (개인정보 제3자 제공 및 위탁)

1. 회사는 이용자의 동의 없이 개인정보를 제3자에게 제공하지 않습니다.

2. 단, 법령에 따라 요구되는 경우 예외적으로 제공될 수 있습니다.

제4장 기타

제9조 (마이크 권한 사용)

1. 스마트보아스 앱은 코골이 소리를 인식하기 위해 마이크 권한을 필요로 합니다.

2. 녹음된 소리는 실시간 분석을 위해 사용되며, 서버에 저장되지 않습니다.

제10조 (책임의 한계)

1. 회사는 이용자의 부주의로 인한 손해에 대해 책임을 지지 않습니다.

2. 회사는 천재지변, 네트워크 장애 등 불가항력적 사유로 인한 서비스 장애에 대해 책임을 지지 않습니다.

Chapter 1: General Provisions

Article 1 (Purpose)

These Terms of Use establish the rights, obligations, and responsibilities of Boaz Health Co., Ltd. (hereinafter referred to as the "Company") and users regarding the use of the SmartBoaz application (hereinafter referred to as the "App") and related services (hereinafter referred to as the "Service") provided by the Company.

Article 2 (Definitions)

1. "User" refers to anyone who uses the Service provided by the Company under these Terms of Use.

2. "App" refers to the SmartBoaz software that users can download and use on smartphones and other devices.

3. "Product" refers to the AI-based snoring relief and sleep care device (SmartBoaz) provided by the Company.

Article 3 (Effectiveness and Changes to Terms)

1. These Terms become effective when posted on the App and the Company's website.

2. The Company may amend these Terms within the scope permitted by applicable laws, and any changes will take effect after prior notice.

Chapter 2: Service Usage

Article 4 (Provision of Service)

1. The Company provides users with an App that works in conjunction with SmartBoaz products to recognize snoring sounds, analyze sleep patterns, and offer personalized sleep management solutions.

2. The Company may update and maintain the service to ensure optimal performance.

3. This service is a wellness product, not a medical device, and is not intended for diagnosis or treatment purposes.

Article 5 (Service Restrictions and Termination)

1. Users may have their access to the service restricted in the following cases: 

o Use for illegal purposes

o Infringement of others' rights

o Disrupting the normal operation of the service

o Entering false information, account sharing, or unauthorized access attempts

2. The Company reserves the right to terminate access to the Service without prior notice in case of violation of these Terms.

Chapter 3: Privacy Policy

Article 6 (Collection and Purpose of Personal Information)

1. The Company may collect the following personal information: 

o Required information: Name, email, device information, snoring sound data

o Optional information: Sleep patterns, health status information

2. The collected personal information is used for the following purposes: 

o Service provision and customer support

o Snoring sound analysis and personalized sleep management

o Service improvement and research development

Article 7 (Retention and Deletion of Personal Information)

1. The Company retains personal information for the period prescribed by law and deletes it immediately once the purpose is achieved.

2. Users may request to view, edit, or delete their personal information at any time.

Article 8 (Provision and Outsourcing of Personal Information)

1. The Company does not provide personal information to third parties without user consent.

2. However, personal information may be provided in exceptional cases as required by law.

Chapter 4: Miscellaneous

Article 9 (Microphone Permission Usage)

1. The SmartBoaz App requires microphone access to recognize snoring sounds.

2. Recorded sounds are used for real-time analysis and are not stored on servers.

Article 10 (Limitation of Liability)

1. The Company is not responsible for damages caused by the user's negligence.

2. The Company is not liable for service disruptions due to force majeure events such as natural disasters or network failures.
